1.PURPOSE
The purpose of the « BulSun REWARD » Conditions of Use is to define the conditions under which BulSun offers its customers and prospects (‘’Members’’) the « BulSun REWARD » service, which is free of charge.
Upon access or use of the « BulSun REWARD » service by the Member, he/she is deemed to have accepted these Conditions of Use.

The BulSun Rewards loyalty programme (henceforth BulSun Rewards or the Programme) is the property of BulSun Hotels. Only individuals over 18 years of age may be the holder of a BulSun Rewards card and only one card may be held per person.The card must be presented for points to be earned and other benefits obtained. The sale or exchange of any  BulSun Rewards card or Programme benefit is strictly forbidden
 
3: DESCRIPTION OF « BulSun REWARD »
The « BulSun REWARD » service is a personal space providing its Members with high value added functions in order to help them maintain a privileged relationship with BulSun. The access to this personal space happens via e-mail.
3.1.
Access requirements
« BulSun REWARD » is only accessible via mail or e-mail and requires the following hardware and software:
- A computer (PC or Mac) with Internet access;
- An Internet browser: « BulSun REWARD » is optimized for an access using Internet Explorer 6.0 or above, Firefox 1.5 or above, Safari. The recommended screen resolution is 1024x768;
- An adapted browser setting: the Member must activate the JavaScript language interpretation functionality on the browser. Moreover, the browser must be configured to accept cookies. (cf. Article 6);
- Adobe Acrobat Reader, version 4.0 or above
- Flash Macromedia Player, version 9.0 or above
3.2.
Creation of « BulSun REWARD »
3.2.1
Creation upon request of « BulSun REWARD » from the www.bulsunhotels.com website From the www.bulsunhotels.com website,Membership banner, the Member can create a personal space with the application form, by clicking on the « BulSun Membership » section.
The Member must then:
1) Identify himself/herself as a customer
2) Fill in a form with his/her last name, first name, post code, E-mail address and phone number
4) Accept these Conditions of Use
The validation of the information entered by the Member finalises the creation stage of his/her personal space.
3.2.2.
Simplified Creation of « BulSun REWARD » for a customer, Following the filling form, The customer will then receive a Email containing a confirmation of account.
3.3.
The Terms & Conditions applicable to « BulSun REWARD » can be found online at www.bulsunhotels.com at the time of the visit. The Member is advised to check regularly the information and Conditions of Use on the www.bulsunhotels.com website for any future new functionalities of « BulSun Membership ».

All individuals staying at a BulSun hotels that forms part of the Programme and operates under the hotel brand names who pay an individual published rate accepted by the said hotel may enjoy the benefits of the  BulSun Rewards Programme. BulSun reserves the right to modify the list of hotels taking part in the Programme at any time.

Cardholders are not entitled to BulSun Rewards membership benefits or to earn points on room accommodation when special rates are paid, nor when payment is made by voucher, nor when the stay is made through other programmes not connected with BulSun, nor when BulSun Rewards points are exchanged for a hotel stay, although these same cardholders are entitled to earn points for all extra expenses (except for those indicated in the following paragraph).
6: COMMITMENT AND RESPONSIBILITY OF THE MEMBER
6.1
The Member undertakes not to hinder the operation of « BulSun REWARD », in any way whatsoever, and not to upload any element likely to contain a virus or any other element likely to damage, intercept or interfere with part or whole of the www.bulsunhotels.com website and mailing system.

BulSun Rewards card holders accumulate points based on the amount on their check-out bill, excluding VAT or equivalent sales tax. Points may not be obtained for banquets, nor the hire of function rooms nor for payment made on behalf of customers nor for services provided on the hotel premises but which are not provided by the hotel such as some SPAS and restaurants in certain hotels. Points will not be available for rooms other than the cardholder's room (unless they are occupied by the cardholder's under the age of eighteen), or for stays at hotels associated BulSun that are not run under the Programme brand names.

With regard to tour operator rates (i) points will be awarded on the basis of the number of nights and hotel brand, and not on the amount billed (see the points table at www.bulsunhotels.com); (ii) points will not be awarded for extras expenses incurred during the stay; (iii) points will only be earned for one room; (iv) points will not be awarded for additional rooms occupied by the cardholder's children under the age of eighteen; (V) points will not be awarded for stays at hotels associated to  BulSun that are not run under the Programme brand names.

Even if BulSun Rewards cardholders are not staying at a hotel taking part in the Programme, they may earn points on the net total amount of their bill in the à la carte restaurant of any of the said hotels taking part in the programme. Points will only be awarded for this concept. BulSun Rewards members will also enjoy a % discount on the net total amount of their bill, depending on their hotel stay period.

Clients may begin to enjoy all of the benefits of the Programme from the moment they identify themselves to be a  BulSun Rewards cardholder with a specific card number and confirmation e-mail, after filling the application form the web sait. For this purpose, cardholders have to present their confirmation e-mail to the reception staff on arrival at the hotel.
Once registered and identified you will become your card at the reception desk.
 
11.
To obtain and use the points, the Programme's Customer Service staff must be in possession of a duly completed registration form for the Programme, either signed by the cardholder or completed online, and you have to become your card from the reception on check in.
 
12.
Benefits obtained from the  BulSun Rewards Programme are not compatible and may not be combined with benefits from other loyalty programmes, unless otherwise established by  BulSun .  BulSun Rewards points may not be transferred to third parties and they will only be credited to the account of the cardholder who obtained them, regardless of the person or entity that paid the bill, whether it was the cardholder, his/her company or a travel agency. Each cardholder may only hold one  BulSun Rewards account, and any  BulSun Rewards card in addition to the first one that might be requested by a cardholder will be cancelled..
 
13.
Free stays in exchange for  BulSun Rewards points at participating  BulSun establishments are subject to the availability of a certain number of rooms assigned to this Programme. Cardholders must send e-mail inquire to  BulSun Membership to make a reservation .Hotel stay in exchange for points will be accepted only with a prior reservation via mail to BulSun Membership.
 
 
14.
If a cardholder or beneficiary who has made a reservation in exchange for points does not actually stay at the hotel and does not cancel the reservation before the anticipated date of arrival, the  BulSun Rewards points that were used to make the reservation will not be returned to the holder's account.
 
15.
BulSun reserves the right to totally or partially cancel or modify the conditions of the  BulSun Rewards Programme at any time.  BulSun will do its utmost to inform cardholders as promptly as possible of the cancellation of the Programme or changes to it and, in all cases, it will publish these amendments on the  BulSun website. The latter may not be held responsible for losses or damage incurred by cardholders in such an event. In the case of the cancellation of the Programme, all points earned by cardholders will automatically become null and void, with cardholders having no right to any compensation. Likewise  BulSun reserves the right to cancel a  BulSun Rewards card belonging to any cardholder if it is used improperly.

16. GUARANTEE - RESPONSIBILITY
16.1
The contact with on www.bulsunhotels.com via e-mail or post is accessible 24 hours a day, 7 days a week. However, testing, monitoring and maintenance operations, including urgent recovery operations, may be carried out by BulSun at any time. In the event the service should be inaccessible, BulSun undertakes to inform the Member accordingly on the « BulSun REWARD » homepage or when connecting to the page. In this respect, BulSun cannot be held responsible.
16.2
Hyperlinks are shown on the « BulSun REWARD » pages and can lead to other Internet websites, including BulSun‘s partners. The content of these Internet websites remains under the sole responsibility of their publishers. As a consequence, BulSun cannot be held responsible for these websites’ content (information available, products, services), nor in the event of a failure to comply with part of or all the publisher’s obligations.
 
17.
The list showing the number of  BulSun Rewards points equivalent to a free stay at hotels taking part in the Programme may be revised and modified by  BulSun at any time.

18.FINANCIAL DISPOSITIONS
« BulSun REWARD » is made available free of charge to the Members. The Internet access from his/her computer (communication and access provider) is payable by the latter.

19.PERSONAL DATA - CONFIDENTIALITY
The registration to « BulSun REWARD » requires the following personal data to be collected from the Member: last name, first name, membership number, postcode, E-mail address and telephone number. The E-mail address and membership number identify the Member, who in addition defines his/her own password for his/her personal space.
In accordance with bulgarian law concerning information technology, files and liberties, the Member is advised that any personal data collected within the frame of the « BulSun Membership » service is necessary to its use.
The data collected on « BulSun Membership » and stored by BulSun in its computer system is likely to be transmitted to internal BulSun departments acting on behalf of several entities of the Group, as well as third parties.
The Member accepts without reserve that the personal data collected via « BulSun REWARD » space can be used by a BulSun subcontractor, in particular to provide and maintain « BulSun REWARD » service as defined in these Conditions of Use of the Client Space.
The membership number assigned to the customer when he/she first registers with BulSun is strictly personal and confidential, and will be required to access his/her « BulSun REWARD » space and his/her personal data. It is the prospect or customer’s duty to inform BulSun if some of the data about him/her or the household constitution such as it was declared to BulSun needs to be modified so that the company has updated individual or household data. If this is not the
case, BulSun cannot be held responsible for the possible damages the customer could suffer and which would result from the fact that the data collected by BulSun about the Member or his/her household have not been updated
 
20. 
BulSun may not be held responsible any lost or delayed mail, or for errors in rates, descriptions or printing errors on printed material sent to cardholders, and reserves the right to correct them.

If any  BulSun Rewards stay is not shown on the corresponding account statement, it will be included in the following one. If a cardholder has a complaint about the points awarded, they must send a copy of their bill together with the number of their  BulSun Rewards card to  BulSun Rewards, Bulkar EOOD,  BulSun Rewards Programme Customer Service, VAT number n.º 102060883 Burgas,Adress: Al.Batenberg 2, Hotel Primoretz,company Bulkar EOOD  for the corresponding points to be awarded. Cardholders have a period of 6 months at their disposal, from the date of their stay, to complain about the allocation of points. Once the said period has elapsed, no further claims on possible points assigned will be accepted.
 
22.
Accounts that remain inactive for over 2 years will automatically be cancelled and all points accumulated will be cancelled. An account shall be understood to be inactive when a  BulSun Rewards cardholder has not stayed at a hotel attached to the Programme for over 2 years.
BulSun reserves the right to assign a different validity period for points assigned in promotions.
 
23.
When filling in the registration form to join the    BulSun Rewards Programme, each cardholder expressly consents to their personal details being gathered and processed in a database owned by Bulkar EOOD, with a registered office at Burgas 8000, Bulgaria , 2 Al.Batenberg, Hotel Primoretz, and to these details being made available to companies from the BulSun Development and companies associated with the    BulSun Rewards Loyalty Programme, in both cases from the tourism, leisure, catering, hotel, travel agency, aviation, car-hire and timeshare sectors inside and outside Bulgaria in order to supervise the    BulSun Rewards card operational, offer cardholders the best possible customer service and send them information about our products and services, those of companies associated with the Programme and those of third parties from the tourism, hotel, travel, catering, leisure, recreation, and timeshare sales and promotion sectors, either by mail and/or by electronic mail.

24.  BulSun must be informed of any change in the cardholder’s name or address in writing e-mail or per post at the maintained address.
 
25. From this moment on, the  BulSun Rewards Programme shall be regulated by these conditions and any previous regulations are declared null and void.
 
26. The Terms and Conditions of the  BulSun Rewards Programme are governed by the corresponding Bulgarian legislation in force at the time. In the event of a dispute, the parties will abide by the jurisdiction of the Burgas Law Courts.
